If you do not agree to all the terms and conditions of this agreement, then you may not access this website or use any Services. You must be at least 18 years of age and possess the legal authority and freedom to enter into these Terms as a binding agreement.

 

This website is operated by Lori Addis Artworks, referred to as “we”, “us” and “our”. By using or accessing any part of this website, or purchasing our products, you engage in our “Service” and agree to be bound by the following Terms and Conditions.

Purchase Terms:

• When buying an item, you agree that:

  1. You are responsible for reading & understanding the full item listing before making a commitment to buy it

  2. You agree to purchase an item when you complete the check-out payment process, and are bound to these Terms and Conditions.

  3. We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your device’s color display will be accurate.

• Prices are in US Dollars.

• Costs for the products, services and any other fees you may incur in connection with your use of our service (such as taxes and possible transaction fees) will be charged to your payment method.

 

Return and Refund Policy:

• Please choose your artwork carefully, and take advantage of the Book a Preview free consultation- where you can visualize your art in place.  Contact me with any questions before making your purchase, to ensure you’ll be happy with your piece.

• Framed artwork is final sale- as frames are custom crafted & built on-demand. (Please consider a returnable unframed purchase if you're feeling unsure.)  No returns or refunds unless the shipping carrier approves a shipment damage claim.  Products are carefully inspected prior to shipment and packed to exceed shipping requirements.

• Unframed artwork is returnable within (7) days of delivery, minus a $25 restock fee- this will be deducted from the refunded amount. Returning artwork must be shipped within 7 days of original delivery date, in its complete original packaging and in perfect condition. No refunds for returns received not in perfect condition, so please keep all your packaging for reuse. No returns after 7 days.

• Buyer is responsible for return shipping fees. The piece must be returned in its complete original packaging &in perfect condition. Shipping fees are non-refundable.

• Return shipments must include tracking, insurance & signature. We are not responsible for lost or damaged return packages. 

• Returns are inspected & refunds processed upon safe receipt of the returned item. Refunds go back to original payment method or store credit.

• We may not authorize your return or exchange if the returned item is not in perfect condition.

• Damaged shipments must be reported & photographed within 48hrs of delivery- no later.   Any damage claims beyond 48 hours are not accepted. 

• If you notice any serious damage to the outside of your package please immediately take photos of:  

  1. Unopened outer packaging damage  

  2. Inner packing materials  

  3. Damage to artwork.

• Complete the 'Report Damaged Shipment' form & send photos within 48 hrs or delivery. Keep the outer packaging, inner packing material & artwork until the claim has been completed.  If the carrier claim is accepted, we only offer a no-cost replacement or store credit equal to the original purchase amount.

• Avoid accidentally damaging your artwork (if a work is unframed), and leave all unpacking and handling of the artwork to a trusted framing professional. We are not responsible for mishandling.

• Cancel or Change order - within 24hrs of original checkout.

Warranties

• No warranties beyond 7 days of original delivery.  

• Purchases must be carefully inspected promptly upon delivery (within 48 hours). If there is any damage, you must describe the extent of damage on the Report Shipment Damage form on our site, and send photos of damage. All claims must be made in writing and delivered to Lori Addis Artworks within 48 hours of receiving.

 

 

Copyright Notice & Intellectual Property

• All artwork and images on our site remain protected under Federal Copyright to Lori Addis Artworks.

• All Copyright & Intellectual Property Rights remain the exclusive property of Lori Addis Artworks. Nothing in these Terms shall be deemed to create a license or grant any Copyright or Intellectual Property Rights.  

• In no way does purchasing an artwork transfer any Copyright or Intellectual Property Rights to the customer. You agree not to reproduce, sell, distribute, license, copy, modify, rent, transmit, publish, adapt, perform, edit or create derivative works of any image or artwork from our website.

• Our Services and all materials therein or transferred thereby, and all Intellectual Property Rights related thereto, are the exclusive property of Lori Addis Artworks.

Trade Partner Membership

• Trade Partner Membership is offered by approval of application, and we may decline or terminate Trade Partner privileges at any time, for any reason, with or without cause, at our sole discretion.

• A valid Business License, Seller’s Permit and completed and signed Resale Certificate is required.

• You agree to notify Lori Addis Artworks of any changes to your Seller’s Permit, business operations and/or location, before making a resale purchase.

• Trade Partner purchases require the use of a personal ID code at checkout, you agree and certify to use this code solely for purchases intended for resale.

• If you’d like to make a purchase that is not for resale, you may not use your personal ID code, sales tax will be applied and/or discounts will not be applicable.

• Trade Partner discounts cannot be combined with other discounts or offers.

• Discount does not apply to custom commission work. 

• All purchases must be paid in full at time of order placement.

• We may change the Terms and Conditions of Trade Partner Membership at any time, at our sole discretion.

• You agree that you will purchase our products and services as a Trade Partner solely for the purpose of reselling items in the regular course of business operations, and/or by conducting business with an individual client.

• You agree not to resell our products or services to the general public, through retail stores, the internet, printed materials or by any other means.

 

Retention of right to change offering:

• We reserve the right, without prior notice, to change the services; change the prices for products and services, stop providing the services or any features of the services we offer; or create limits for the services.

• We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

• We may permanently or temporarily suspend or terminate access to the Services without notice and liability for any reason, or for no reason.

• We reserve the right to refuse any order you place with us, at our sole discretion. 

 

Privacy & Personal Information

Promotional emails and content

• We may send promotional messages time to time by mail, email. You may opt out at any time. Please notify us at any time if you do not want to receive promotional materials or notices.

 

Right to suspend or cancel user account

• We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations.

 

Indemnification

• You agree to indemnify, defend and hold harmless Lori Addis Artworks and our directors, officers, contractors, employees, affiliates, suppliers, service providers, or licensors from any demand, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the Services or products offered on the website.

 

Limitation of liability

• To the maximum extent permitted by applicable law, in no event shall Lori Addis Artworks, our directors, officers, contractors, employees, affiliates, suppliers, service providers, or licensors be liable for any for any injury, loss, claim, or any direct, indirect, punitive, incidental, special, consequential or exemplary damages of any kind, including without limitation, damages for loss of profits, lost revenue, lost savings, loss of data, replacement costs, goodwill, use or other intangible losses, arising out of or relating to the use of, or inability to use, the Services. To the maximum extent permitted by applicable law, Lori Addis Artworks assumes no liability or responsibility for any (i) errors or omissions of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our Service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 

Right to change and modify Terms

• We reserve the right to modify these terms from time to time at our sole discretion. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms, do not use or access the website or the service.

 

Preference of law and dispute resolution

• These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the State of California in the United States, without respect to its conflict of laws principles.

• MEDIATION - ARBITRATION: All disputes arising out of this agreement shall be submitted to mediation in accordance with the rules and procedures of Arts Arbitration and Mediation Services, a program of California Lawyers for the Arts. If mediation is not successful in resolving all disputes arising out of this agreement, those unresolved disputes shall be submitted to final and binding arbitration. The arbitrator shall be selected in accordance with the rules of Arts Arbitration and Mediation Services, a program of California Lawyers for the Arts. If such services are not available, the dispute shall be submitted to arbitration in accordance with the laws of the State of California. The arbitrator's award shall be final, and judgment may be entered upon it by any court having jurisdiction thereof.
